You agree by clicking Signup or similar registry assessing or using our services, you are agreeing to enter into a legally binding and enforceable contract with searchkar.in. If you do not agree to the terms of this Agreement, please do not sign up and do not access or use the services provided by searchkar.in; further if you wish to terminate this Agreement at any time, you can close or delete the account with searchkar.in
This agreement is applicable on all the services provided by searchkar.in either through web-based browser or application and by app and by agreeing to the terms and conditions of this Agreement, you shall be referred to as Member of searchkar.in Searchkar.in
Searchkar.in reserve all its right to modify this agreement, Privacy Policy from time to time without any intimation or notice to you and you are expected to read the latest version of the terms and conditions of this Agreement and in case you have any reservation with respect to changes carried out in the terms and conditions of this Agreement by us you may close or delete your account. In case you continue to use our services, it is deemed that you have given your consent to the terms and conditions of this Agreement and you agree to the same
As the services offered by us are of premium quality and related to the business and by signing up to this Agreement, you represent that you are the above 18 years of age and have capacity to enter into legally binding and enforceable agreement. You also represent that you are availing these services under your real name. Please do note that creation of account with false information is in violation of our terms and conditions and law and we have all the rights to suspend or block you from excessing these services.
You being account holder agree to use a strong password and shall keep it confidential. You shall not transfer your account to anyone in any circumstances and you shall always be following the business and professionals’ ethics and guidelines as may be applicable on your profession and you shall be responsible for anything that will happen through your account with searchkar.in and you agree that contents posted by you is of your own and you have not violated any third-party rights or intellectual property rights of any third party.
In case you are accessing our paid services you agree to pay us the applicable fee and applicable taxes on time. Failure to pay the said fee will result in termination of paid services and you also agree that you shall pay the amount in Indian rupee and any foreign exchange fee shall be borne by you. You can pay and store your payment method for timely payment of the aforesaid fee.
You agree that you own the content and information that you submit or post on searchkar.in and you are granting searchkar.in worldwide, transferrable and sublicensable right to use, copy, modify, distribute, publish and process information and content that you provide through ours services without any further consent or notice and/or consideration to you or others. You agree that you are providing content or information that does neither violate any law nor anyone's right including intellectual property right and you are expressly representing and assuring searchkar.in that the information and content provided by you are lawful and of high standard. You agree that if searchkar.in notified by any third party about any violation or concern with respect to the contents or information, searchkar.in can remove or sensor or delete or removed certain or entire information or content. You agree that searchkar.in have not represented or promised to you to store or keep showing all the information and content that you have posted on searchkar.in and you discharge searchkar.in from all such obligations.
NO WARRANTIES:
SEARCHKAR.IN MAKE NO REPRESENTATION OR WARRANTY ABOUT THE SERVICES, INCLUDING ANY REPRESENTATION THAT THE SERVICES OFFERED BY IT WILL BE UNINTERRUPTED OR ERROR-FREE. BY SIGNING UP, YOU AGREE THAT SEARCHKAR.IN IS PROVIDING THE SERVICES (INCLUDING CONTENT AND INFORMATION) ON AN “AS IS” AND “AS AVAILABLE” BASIS. YOU AGREE THAT TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, SEARCHKAR.IN DISCLAIM ANY IMPLIED OR STATUTORY WARRANTY, INCLUDING ANY IMPLIED WARRANTY OF TITLE, ACCURACY OF DATA, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
LIMITATION OF LIABILITIES
TO THE FULLEST EXTENT PERMITTED BY LAW, UNLESS SEARCHKAR.IN HAS ENTERED INTO A SEPARATE WRITTEN AGREEMENT WITH YOU THAT OVERRIDES THIS AGREEMENT, SEARCHKAR.IN WILL NOT BE LIABLE IN CONNECTION WITH THIS AGREEMENT FOR LOSS OF PROFITS OR LOSS OF ANY BUSINESS OPPORTUNITIES, REPUTATION, LOSS OF DATA OR ANY DIRECT OR INDIRECT, INCIDENTAL OR CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES. SEARCHKAR.IN WILL NOT BE LIABLE TO YOU IN CONNECTION WITH THIS AGREEMENT FOR ANY AMOUNT THAT EXCEEDS (A) ONE MONTH’S FEES PAID OR PAYABLE BY YOU TO SEARCHKAR.IN FOR THE SERVICES DURING THE TERM OF THIS AGREEMENT, IF ANY, OR (B) RS.1,000/- WHICHEVER IS HIGH. YOU AGREE THAT the terms of this Agreement shall be govern by the Laws of India and you specifically agree to the jurisdiction of North Goa, Goa, India and Laws of India in case of any dispute between you and searchkar.in In case you have any concern or dispute concerning the services offered or provided by searchkar.in, you specifically agree to resolve the dispute amicably with the searchkar.in
If any provisions of these Terms are held to be enforceable or invalid, such provision will be deemed to be severed from this Agreement and every other provision of this Agreement shall remain in full force and effect. All notices, requests or other communications hereunder shall be in writing and shall be deemed to be have been duly given if it is communicated to you at the registered email.
